I. General Provisions

This Privacy Policy outlines how the personal data of Users necessary for providing electronic services via the website agvo.pl (hereinafter referred to as the “Service”) are collected, processed, and stored.

The Service collects only the personal data necessary for the provision and development of the services offered within it.

Personal data collected through the Service are processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter “GDPR”), and the Polish Act on the Protection of Personal Data of 10 May 2018.

II. Data Controller

III. Purpose of Collecting Personal Data

Personal data are used for the following purposes:

  • Registration of an account and verification of the User’s identity,
  • Enabling login to the Service,
  • Execution of the agreement concerning services and e-services,
  • Communication with the User (live chat, contact form, etc.),
  • Sending newsletters (upon the User’s consent),
  • Operating a commenting system,
  • Providing community services,
  • Promoting the Controller’s offerings,
  • Marketing, remarketing, and affiliation,
  • Personalizing the Service for Users,
  • Conducting analytical and statistical activities,
  • Debt collection,
  • Establishing and pursuing claims or defending against them.
  1. Providing data is voluntary but necessary to conclude an agreement or use other functionalities of the Service.

IV. Types of Personal Data Processed

The Controller may process the following personal data of the User: name and surname, date of birth, residential address, email address, phone number, NIP (Tax Identification Number).

V. Period of Personal Data Processing

Users’ personal data will be processed for the following periods:

  • When the basis for processing is the performance of an agreement – until the claims related to it become time-barred,
  • When the basis for processing is consent – until it is withdrawn, and after withdrawal, until the claims become time-barred.

In both cases, the limitation period is 6 years, and for periodic performance claims and claims related to business activities – 3 years (unless a specific provision provides otherwise).

VI. Sharing of Personal Data

Users’ personal data may be shared with entities related to the Controller, its subcontractors, entities cooperating with the Controller, e.g., companies handling e-payments, courier/postal service providers, legal offices.

Users’ personal data will not be transferred outside the European Economic Area (EEA).

VII. Users’ Rights

A User of the Service has the right to access their personal data, rectify them, delete them, restrict processing, transfer data, object to processing, and withdraw consent at any time (which does not affect the lawfulness of processing based on consent before its withdrawal).

Requests to exercise the rights arising from the above should be sent to the email address: biuro@agvo.pl.

The Controller will fulfill or refuse to fulfill the request without undue delay – within a maximum of one month from its receipt.

The User has the right to lodge a complaint with the President of the Office for Personal Data Protection if they believe that the processing violates their rights and freedoms (GDPR).

VIII. Cookies

The Service collects information using cookies – session, persistent, and third-party cookies.

The collection of cookies supports the proper provision of services within the Service and serves statistical purposes.

The User can specify the scope of access of cookies to their device in the browser settings.

IX. Automated Decision-Making and Profiling

Users’ data cannot be processed in an automated manner such that it would result in any decisions being made regarding them.

Users’ data may be profiled to tailor content and personalize offerings upon their consent.

X. Final Provisions

The Controller reserves the right to make changes to the Privacy Policy, provided that the rights of Users are not limited.

Information about the introduced changes will appear in the form of a notice available on the Service.

In matters not covered by this Privacy Policy, the provisions of GDPR and Polish law apply.
